1. Definitions

2. Scope of Services

2.1 We provide waste and rubbish clearance services for domestic and commercial customers, including but not limited to collection of household waste, garden waste, bulky items, and general non-hazardous rubbish.

2.2 The exact scope of the service, including the amount and type of waste to be removed, any access restrictions, and the required time and date, will be agreed at the time of booking based on the information you provide.

2.3 We reserve the right to refuse service where the waste is unsafe, hazardous, prohibited by law, incorrectly described, or where access to the premises presents a significant health and safety risk to our staff or third parties.

3. Booking Process

3.1 Bookings may be made by telephone, email, or through any other booking method we make available from time to time.

3.2 When making a booking, you must provide accurate and complete information, including your contact details, the collection address, description and approximate volume or weight of the waste, access details, parking information, and any special requirements.

3.3 Any quote provided before our arrival is based on the information supplied by you. It is not binding if the actual volume, nature or weight of the waste, or the site conditions, differ from your description. In such cases, we may adjust the price, revise the booking, or cancel the service in accordance with these Terms and Conditions.

3.4 Your booking is not confirmed until we have acknowledged acceptance of your request and agreed a date and time window for provision of the services.

3.5 We will make reasonable efforts to arrive within the agreed time window, but this is an estimate only. We shall not be liable for any loss or inconvenience caused by delays arising from circumstances beyond our reasonable control, such as traffic, weather, accidents, or operational issues.

4. Access and Parking

4.1 You are responsible for ensuring that our staff have safe, appropriate and unobstructed access to the premises at the agreed time.

4.2 You must arrange any necessary parking or permits and ensure that suitable parking is available as close as reasonably possible to the loading point. Any parking charges, fines or penalties incurred due to inadequate arrangements or instructions may be charged back to you.

4.3 If we are unable to gain suitable access or park safely to carry out the service, we may cancel the visit or charge a wasted journey fee or additional waiting time, at our discretion.

5. Waste Description and Exclusions

5.1 You are responsible for accurately describing the waste to be collected, including the type, volume, approximate weight, and any special characteristics or risks.

5.2 Unless expressly agreed in writing in advance, we do not collect hazardous or specialist waste, including but not limited to asbestos, medical waste, clinical waste, chemicals, solvents, oils, fuels, gas cylinders, explosives, radioactive materials, pressurised containers, or any waste classed as hazardous under applicable regulations.

5.3 We reserve the right to refuse to remove any items which, in our reasonable opinion, may be unsafe to handle, illegal to carry, unsuitable for transport, or likely to cause damage or contamination.

5.4 If hazardous or prohibited materials are found mixed with general rubbish, we may decline to remove them, apply additional charges for safe handling, or cancel the service.

6. Pricing and Quotations

6.1 Our charges are typically based on the volume, weight, and type of waste removed, as well as labour, access conditions, and any applicable disposal or recycling costs.

6.2 Any quotation given prior to attendance is an estimate only and may be revised when our team inspects the waste and site conditions on arrival.

6.3 If the price needs to be revised on site, we will inform you before starting work. If you do not accept the revised price, you may decline the service and no further charges will be payable, except for any agreed call-out or wasted journey fees.

6.4 All prices are stated in pounds sterling and may be subject to VAT or other applicable taxes, where relevant.

7. Payments

7.1 Payment is due in full on completion of the service, unless otherwise agreed in advance in writing.

7.2 We accept the payment methods we specify at the time of booking, which may include cash, debit or credit card, bank transfer or other electronic payment options.

7.3 For business customers or account holders, we may agree alternative payment terms. In such cases, invoices shall be payable within the period stated on the invoice. Late payments may incur interest and administration charges in accordance with applicable law.

7.4 We reserve the right to withhold or suspend services if payment is not made as required or if previous invoices remain overdue.

8. Cancellations, Rescheduling and Wasted Journeys

8.1 You may cancel or reschedule a booking by contacting us during our normal working hours.

8.2 Where you cancel or reschedule more than 24 hours before the agreed time window, no cancellation fee will normally apply.

8.3 Where you cancel or reschedule less than 24 hours before the agreed time window, we reserve the right to charge a late cancellation fee to cover our administrative and operational costs.

8.4 If our team arrives at the premises at the agreed time and is unable to carry out the service due to reasons outside our control, such as no access, no authorised person present, unsafe conditions, incorrect address, or refusal on site, we may charge a wasted journey fee.

8.5 We may cancel or reschedule the service due to circumstances beyond our reasonable control, including but not limited to severe weather, accidents, illness, equipment failure or legal restrictions. In such cases, we will seek to provide an alternative date or a refund of any amounts paid in advance for the affected service.

9. Customer Obligations

9.1 You must ensure that the waste is ready for collection at the agreed time and is located in an accessible and safe area, unless we have specifically agreed to remove items from inside the premises or a particular location.

9.2 You must not present for collection any waste that is illegal to possess, transport or dispose of, or which fails to comply with applicable waste regulations.

9.3 You must provide all relevant information about the premises, including any risks, fragile surfaces, restricted access points, and any potential hazards.

9.4 You agree to supervise our staff while on site if required, and to ensure that children, pets and other persons are kept at a safe distance from the working area.

10. Liability and Damage

10.1 We will exercise reasonable care and skill in providing the services. However, minor scuffs, marks or wear and tear that may occur during the normal process of waste removal shall not be considered damage.

10.2 You must notify us of any alleged damage to property or items as soon as reasonably practicable and in any event within 48 hours of completion of the service. We may require evidence, including photographs and access to inspect the alleged damage.

10.3 Our liability for loss or damage arising out of or in connection with the services shall be limited to the direct cost of repair or replacement of the damaged property, up to a maximum of the price paid for the specific service in question or such amount as is recoverable under our relevant insurance policies, whichever is greater.

10.4 We shall not be liable for any indirect, special or consequential losses, including but not limited to loss of profit, loss of business, loss of opportunity, or loss arising from delays or failure to perform which are caused by events beyond our reasonable control.

10.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be limited or excluded.

11. Title to Waste and Environmental Responsibility

11.1 Once the waste has been loaded onto our vehicle and payment has been made or agreed, ownership of the waste transfers to us, subject to any applicable legal restrictions.

11.2 We are committed to handling waste in a responsible manner, in accordance with applicable environmental and waste management legislation. We will seek to reuse or recycle materials where reasonably practicable, and dispose of residual waste through licensed facilities.

11.3 You acknowledge that certain items or materials may be subject to specific disposal or recycling rules and that additional charges may apply for special handling or processing.

12. Compliance with Waste Regulations

12.1 We will operate in compliance with relevant UK waste laws, including duty of care obligations, licensing requirements, and record-keeping related to waste transfer, as applicable to our operations.

12.2 Where required, we may provide or complete waste transfer notes or other documentation relating to the collection, transportation and disposal of waste.

12.3 You agree to provide accurate information necessary for any required documentation and to cooperate with us to ensure that all legal and regulatory requirements are met.

12.4 You remain responsible for any breach of waste legislation arising from your failure to describe the waste correctly, your provision of prohibited materials, or any misrepresentation made to us.

13. Insurance

13.1 We maintain insurance cover which we consider appropriate for a waste collection and rubbish clearance business of our nature and size.

13.2 Details of our insurance cover are available on request. Our total liability to you will not exceed the limits of such insurance, except where required by law.

14. Complaints and Dispute Resolution

14.1 If you are dissatisfied with any aspect of our service, you should contact us as soon as possible, providing full details of your concerns.

14.2 We will investigate complaints promptly and aim to respond within a reasonable time frame with our findings and, where appropriate, our proposed resolution.

14.3 In the event of a dispute which cannot be resolved through our internal complaints procedure, both parties shall attempt in good faith to resolve the matter through negotiation before considering formal legal proceedings.

15. Data Protection and Privacy

15.1 We will collect and process personal data about you for the purpose of managing bookings, providing our services, handling payments, and communicating with you.

15.2 We will handle your personal information in accordance with applicable data protection laws and use it only for legitimate business purposes or as otherwise required by law.

15.3 You are responsible for ensuring that any personal data you provide to us about third parties, such as tenants or employees, has been collected and shared in accordance with relevant legal requirements.

16. Variations to Terms

16.1 We reserve the right to amend or update these Terms and Conditions from time to time. Any changes will apply to bookings made after the date the updated terms are published or notified.

16.2 The version of the Terms and Conditions in force at the time of your booking will normally govern that specific service, unless we agree otherwise in writing.

17. Severability

17.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

18. Governing Law and Jurisdiction

18.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the services, shall be governed by and construed in accordance with the laws of England and Wales.

18.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of our rubbish clearance and waste collection services.

19. Entire Agreement

19.1 These Terms and Conditions, together with any written quotation or confirmation of booking issued by us, constitute the entire agreement between you and us in relation to the services and supersede any prior understandings or arrangements, whether written or oral.

19.2 No variation of these Terms and Conditions shall be effective unless agreed in writing by an authorised representative of Rubbish Clearance Putney.
